Grandparents Rights

Texas law presumes that it is in the best interest of a child that their parents are the managing conservators (have legal custody). Therefore, it may be difficult for grandparents to prove that they should have that legal right. However, it is not impossible. To have their case heard, the grandparent must first have standing. It is extremely important to consult with a knowledgeable family law attorney about these type of complex matters. If the grandparent does not meet both the procedural and substantive requirements of standing, then their suit will be dismissed.
