CHILD CUSTODY & VISITATION
Obtain Custody and/or Visitation
In Texas, courts divide child custody issues into two categories, conservatorship (custody) and possession and access (visitation). Texas has two conservatorship options, Sole Managing Conservator where one parents makes all major decisions, and Joint Managing Conservator, where both parents jointly make decisions. When determining rights and duties, the court will decide what's in the "best interest of the child."
Possession and access refers to the visitation schedule the non custodial parent has with the child. Texas has a standard possession schedule available, however, parents can agree to a different possession and access schedule, so long as that schedule is in the best interest of the child.
